• LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES;
• LOSS OF DATA OR INFORMATION;
• LOSS OF GOODWILL OR REPUTATION;
• PERSONAL INJURY OR PROPERTY DAMAGE;
• COST OF SUBSTITUTE GOODS OR SERVICES;
• ANY OTHER INTANGIBLE LOSSES,

ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO JET'S PIZZA DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

The limitations of liability set forth in this section are a fundamental element of the basis of the bargain between Jet's Pizza and you, and Jet's Pizza would not have provided the Services without such limitations.

Certain state laws, including those of some U.S. states, do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.

9. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza and its officers, directors, shareholders, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms or any applicable law or regulation;
• Your violation of any third-party rights, including any intellectual property rights or privacy rights;

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except for disputes that qualify for small claims court, all disputes arising out of or related to these Terms or the Services that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in the English language and shall take place in the United States.

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of these Terms, including any claim that all or any part of these Terms is void or voidable. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND JET'S PIZZA EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you and Jet's Pizza each waive any right to a jury trial and each waive any right to participate in a class action lawsuit or class-wide arbitration.

11.4 Exceptions

Notwithstanding the foregoing, nothing in this section shall prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

12. Term and Termination

These Terms shall remain in full force and effect while you use the Website or Services. We reserve the right, in our sole discretion, to:

• Terminate or suspend your account and access to the Services immediately, with or without notice, for any reason, including without limitation if we believe that you have violated these Terms;
